Beazer Homes Reaches Settlement with EPA

December 2, 2010 at 4:30 PM EST

ATLANTA, Dec 02, 2010 (BUSINESS WIRE) --

Beazer Homes USA, Inc. (NYSE: BZH) (www.beazer.com) (the "Company") announced today that it has resolved a previously-disclosed investigation and enforcement action brought by the U.S. Environmental Protection Agency ("EPA") concerning stormwater discharge at some of the Company's communities while under construction. The action is the latest in a series of enforcement efforts by EPA against homebuilders and other companies regarding stormwater compliance. The settlement concludes the investigation by EPA into this matter with respect to the Company.

Pursuant to the settlement, the Company has entered into a consent decree with EPA, as well as the States of Colorado, Florida, Indiana, Maryland, Nevada, and Tennessee, and the Commonwealth of Virginia. Under the terms of the consent decree, the Company has agreed to pay a civil penalty, and to create training programs for its employees, as well as a periodic compliance reporting system.

Since the Company was first contacted by EPA in 2003, it has fully cooperated with all requests for information from the Justice Department and EPA. Since that time, the Company has also established a comprehensive stormwater management program to ensure compliance with the Clean Water Act, similar state regulations and the terms of the consent decree itself. The Company takes environmental compliance issues seriously and prides itself in maintaining good standing with federal, state and local environmental regulators.

Beazer Homes USA, Inc., headquartered in Atlanta, is one of the country's ten largest single-family homebuilders with continuing operations in Arizona, California, Delaware, Florida, Georgia, Indiana, Maryland, Nevada, New Jersey, North Carolina, Pennsylvania, South Carolina, Tennessee, Texas, and Virginia.
